Operational Aesthetic™ Terms of Service

Welcome to Operational Aesthetic.

These Terms of Service ("Terms") govern your access to and use of the Operational Aesthetic website, products, services, and related experiences (collectively, the "Services").

By purchasing, accessing, or using the Services, you agree to these Terms and to our Privacy Policy.

If you do not agree to these Terms, please do not purchase or use the Services.

1. About Operational Aesthetic

Operational Aesthetic is a methodology and service designed to help individuals identify recurring patterns across their preferences, experiences, visual evidence, decisions, and other information they choose to provide.

The Services may include:

  • A guided questionnaire or intake process
  • Submission of photographs or other visual evidence
  • Creation of a personalized Identity Infrastructure™
  • Related personalized materials
  • Pattern Lab™ materials and prompts
  • Other products, tools, resources, or services that Operational Aesthetic may introduce over time

The specific products, features, and processes available may change as Operational Aesthetic develops.

2. Eligibility

Operational Aesthetic is intended for individuals 18 years of age or older.

By purchasing or using the Services, you represent that:

  • You are at least 18 years old
  • You have the legal capacity to enter into these Terms
  • The information you provide is accurate to the best of your knowledge
  • You have the right to provide any photographs or other materials you submit

3. Your Purchase

When you purchase an Operational Aesthetic product or service, you agree to provide the information reasonably necessary to complete your purchase and receive the Services.

We reserve the right to refuse or cancel an order when reasonably necessary, including where we suspect fraud, misuse, or a violation of these Terms.

Prices, products, availability, and features may change over time.

The price applicable to your purchase will be the price presented to you at the time of purchase.

4. Your Questionnaire and Visual Evidence

The quality and usefulness of your Identity Infrastructure depend in part on the information and visual evidence you provide.

You are responsible for providing information that is reasonably accurate and representative of your experiences and preferences.

You are not required to disclose information you do not wish to share.

You should only submit photographs, images, written materials, or other content that you have the right to provide.

You should not submit:

  • Content you do not have permission to use
  • Private information belonging to another person without appropriate authorization
  • Content that is unlawful or fraudulent
  • Content that intentionally misrepresents your identity or circumstances

Operational Aesthetic is not responsible for information you choose not to provide or for conclusions that cannot reasonably be drawn because relevant information was omitted.

5. Your Identity Infrastructure™

Your Identity Infrastructure™ is a personalized synthesis created from the information and visual evidence you provide.

It is designed to help you recognize recurring patterns in your own preferences, decisions, experiences, and expression.

Your Identity Infrastructure™ is not a diagnosis, psychological assessment, medical evaluation, legal opinion, financial advice, or other professional determination.

It is a framework for reflection, decision-making, and personal application.

You remain the final decision-maker regarding how you interpret and use your Identity Infrastructure™.

6. AI and Human Review

Operational Aesthetic may use artificial intelligence, automated technologies, and human review in creating and quality-checking the Services.

The specific technologies and degree of human involvement may change over time.

AI-generated observations and analyses may contain errors, omissions, or interpretations with which you disagree.

Operational Aesthetic does not guarantee that every observation or recommendation will be correct or appropriate for every situation.

You should use your own judgment when applying your Identity Infrastructure™.

7. Pattern Lab™

Pattern Lab™ is designed to allow you to use your Identity Infrastructure™ as context for future conversations with an AI service.

Operational Aesthetic may provide you with Pattern Lab™ instructions, prompts, and your Identity Infrastructure™ in a format designed to be copied into an AI platform of your choice.

You may choose to use services such as ChatGPT, Claude, Grok, or another AI platform.

Those third-party services are not owned or controlled by Operational Aesthetic.

Your use of those services is governed by their own terms, privacy policies, and other applicable rules.

Operational Aesthetic is not responsible for:

  • The availability of a third-party AI service
  • Changes to a third-party AI service
  • Responses generated by a third-party AI service
  • How a third-party AI provider stores or processes information you submit directly to it
  • Any decisions you make based on conversations with a third-party AI service

8. Intellectual Property

Operational Aesthetic owns or has the right to use the intellectual property associated with the Services, including:

  • The Operational Aesthetic name and brand
  • Trademarks
  • Methodology
  • Frameworks
  • Processes
  • Questionnaires
  • Templates
  • Prompts
  • Systems
  • Website content
  • Educational materials
  • Other proprietary materials

Purchasing an Operational Aesthetic product does not transfer ownership of this intellectual property to you.

You receive a personal, non-exclusive right to use your purchased materials for your own personal use.

You may not reproduce, distribute, resell, sublicense, publish, or commercially exploit Operational Aesthetic's proprietary materials without our written permission.

9. Your Content

You retain ownership of photographs, written information, questionnaire responses, and other original content that you provide to Operational Aesthetic, subject to the rights necessary for us to provide the Services.

By submitting content to Operational Aesthetic, you grant us a limited, non-exclusive right to use, process, reproduce, store, and modify that content as reasonably necessary to:

  • Provide the Services
  • Create your Identity Infrastructure™
  • Provide customer support
  • Conduct quality review
  • Maintain and improve the Services
  • Comply with applicable law

Any additional use of your identifiable content, such as public marketing or publication, will require your separate permission where required by applicable law.

Our handling of your personal information is also governed by our Privacy Policy.

10. Aggregated and De-Identified Information

Operational Aesthetic may create aggregated or appropriately de-identified information from information provided through the Services.

We may use such information to:

  • Improve our methodology
  • Conduct research
  • Identify trends and patterns
  • Develop new products
  • Create consumer or market insights
  • Develop educational materials
  • Support future research or commercial offerings

We will not knowingly use information represented as de-identified to identify an individual except where permitted or required by law.

Any use of personal information beyond the purposes described in our Privacy Policy will be handled in accordance with applicable law and any required notice or consent.

11. Your Relationship With Operational Aesthetic

Operational Aesthetic provides a framework and tools designed to help you recognize and apply patterns in your own life.

We do not guarantee that using the Services will result in:

  • A particular personal outcome
  • Improved purchasing decisions
  • Improved career outcomes
  • Improved relationships
  • Changes in appearance
  • Increased confidence
  • Reduced decision-making time
  • Any other specific result

Your results depend on many factors, including the information you provide and how you choose to apply what you receive.

12. No Professional Advice

Operational Aesthetic is not a substitute for professional advice.

The Services are not intended to provide:

  • Medical advice
  • Mental health treatment
  • Psychological diagnosis
  • Legal advice
  • Financial advice
  • Nutritional or health treatment
  • Any other professional service requiring a licensed professional

If you need professional advice, consult an appropriately qualified professional.

13. Changes to the Services

Operational Aesthetic is an evolving business.

We may change, improve, add, remove, suspend, or discontinue features, products, or portions of the Services from time to time.

We will make reasonable efforts to provide purchased deliverables that correspond to the product you purchased.

Changes to future products or features do not necessarily entitle you to a refund for products already delivered.

14. Refunds and Cancellations

Operational Aesthetic creates personalized products based on the information and materials you provide.

Before Personalized Work Begins

You may request a full refund at any time before Operational Aesthetic has begun personalized work on your order.

For purposes of this policy, personalized work generally begins when we begin reviewing your submitted questionnaire and visual materials for the purpose of creating your Identity Infrastructure™.

If you have purchased the Service but have not yet submitted your required intake materials, you may request a full refund.

After Personalized Work Begins

Once personalized analysis or creation of your Identity Infrastructure™ has begun, the purchase is generally non-refundable because the Service involves individualized work created specifically for you.

Founding Member Guarantee

We want our earliest customers to feel confident taking a chance on something we're building.

Founding Members receive an additional 14-day satisfaction guarantee following delivery of their Identity Infrastructure™.

If you are one of our Founding Members and your Identity Infrastructure™ does not feel meaningfully useful to you, contact us within 14 days of delivery and tell us what isn't working.

We will review the issue with you and determine the most appropriate way to make it right. Depending on the circumstances, this may include:

  • Clarification of your Identity Infrastructure™
  • Corrections to an identified error
  • A revision or additional analysis
  • A refund

The Founding Member Guarantee is intended to give our earliest customers a meaningful opportunity to provide feedback while we continue to refine the product.

It does not guarantee that every conclusion will match your expectations or that you will agree with every observation in your Identity Infrastructure™.

Service Issues

If you believe there is an error in your deliverables, a technical problem prevented you from receiving the Service, or Operational Aesthetic otherwise failed to provide the purchased Service as described, please contact us at sarah@operationalaesthetic.com.

We will make a reasonable effort to correct the issue or otherwise make it right.

Nothing in this policy limits any refund, cancellation, or other rights that cannot legally be waived.

15. Website Availability

We make reasonable efforts to keep the website and Services available and functioning properly.

However, we do not guarantee that the website or Services will always be:

  • Available
  • Uninterrupted
  • Error-free
  • Secure
  • Compatible with every device or browser

The Services may occasionally be unavailable because of maintenance, technical problems, third-party outages, or circumstances beyond our reasonable control.

16. Prohibited Uses

You agree not to use the Services to:

  • Violate applicable law
  • Infringe another person's intellectual property or privacy rights
  • Upload content you do not have permission to provide
  • Attempt to gain unauthorized access to our systems
  • Interfere with the operation or security of the Services
  • Copy, reproduce, distribute, resell, or commercially exploit Operational Aesthetic's proprietary materials without permission
  • Reverse engineer or attempt to reproduce the Operational Aesthetic methodology or underlying systems
  • Use the Services to develop a competing service based substantially on Operational Aesthetic's proprietary materials
  • Misrepresent your identity or relationship with Operational Aesthetic

17. Third-Party Services

The Services may depend on or interact with third-party services.

This may include services used for:

  • Payment processing
  • Website hosting
  • Storage
  • Communications
  • Analytics
  • Artificial intelligence
  • Authentication
  • Other technology infrastructure

Third-party services are governed by their own terms and policies.

Operational Aesthetic is not responsible for the acts, omissions, availability, or policies of third-party providers.

18. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.

Operational Aesthetic makes no warranties, express or implied, regarding the Services, including warranties of:

  • Accuracy
  • Reliability
  • Fitness for a particular purpose
  • Non-infringement
  • Availability
  • Results

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

19. Limitation of Liability

To the maximum extent permitted by applicable law, Operational Aesthetic and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the Services.

To the maximum extent permitted by law, our total liability arising from or relating to the Services will not exceed the amount you paid to Operational Aesthetic for the specific product or service giving rise to the claim.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

20. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Operational Aesthetic and its owners, employees, contractors, and service providers from claims, damages, liabilities, costs, and expenses arising from:

  • Your violation of these Terms
  • Your misuse of the Services
  • Your violation of another person's rights
  • Content you submit that you do not have the right to provide
  • Your violation of applicable law

21. Termination

We may suspend or terminate your access to the Services if you materially violate these Terms, engage in fraud or abuse, or otherwise misuse the Services.

You may stop using the Services at any time.

Termination does not eliminate obligations that by their nature should continue, including provisions concerning intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution.

22. Governing Law

These Terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law principles.

Any dispute arising from these Terms or the Services will be handled in accordance with applicable Oklahoma law and in the appropriate courts located in Oklahoma, unless applicable law requires otherwise.

23. Changes to These Terms

We may update these Terms as Operational Aesthetic develops.

When we make material changes, we may provide notice through the website or other reasonable means.

The updated Terms will become effective on the date stated at the beginning of the revised Terms.

Your continued use of the Services after the updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.

24. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms presented to you at the time of purchase, constitute the agreement between you and Operational Aesthetic regarding the Services.

If a provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
